Terms of service
Article 1: Scope of application
These Terms apply to customers who use the shopping site (hereinafter referred to as the "Official Online Store") provided by BONAVENTURA Co., Ltd. (hereinafter referred to as the "Company") and customers who purchase our products (hereinafter referred to as the "Customer"). When a customer uses the official online store, it is assumed that the customer agrees to these terms.
Article 2: Changes to Terms
If changes to these Terms are in the general interest of customers, the Company may change these Terms without prior consent from customers. Other changes to the terms and conditions shall be in accordance with Article 548-4, Paragraph 1, Item 2 of the Revised Civil Code, and customers who do not wish the changed terms to apply will be given the right to cancel, or a sufficient grace period will be provided between notification of the change and its application.
Article 3: Suspension and interruption of service provision, etc.
In order to maintain the operating status of the Official Online Store in good condition, the Company may suspend or stop the service of the Official Online Store and conduct maintenance inspections, etc. without the customer's prior consent for other reasons.
Our company will not be held responsible for any disadvantages that may occur to the customer during that time.
Article 4:Membership
Among customers, those who register as members using the form prescribed by our company are considered "members." Members will be required to set their own ID and password.
Members shall comply with the "Membership Terms and Conditions" stipulated by the Company.
Article 5: Newsletter membership
Among our customers, those who have registered for newsletter subscription using the form prescribed by our company are considered "newsletter members." When registering as a member, you will be required to register your e-mail address, but if there are any changes to the submitted information, you must promptly re-register or revise the content using the format specified by our company.
Article 6: Order changes and cancellations
As a general rule, the details of the ordered product cannot be changed after the customer has confirmed the order. In addition, order cancellations are limited to orders that have not yet been prepared for shipment. Procedures related to such matters shall follow the format prescribed by our company.
Article 7: Regarding product returns and exchanges
If the delivered product is found to be damaged, soiled, defective, incorrect product, incorrect quantity, etc., please notify us within 7 days of receiving the product using our prescribed format. Regarding the procedure, please follow the instructions of our customer support after notification. In addition, we do not accept any returns or exchanges of products due to customer convenience. Please note that returns and exchanges must be completed by the customer who purchased the item, regardless of whether it is a gift item.
In addition, returns and exchanges for products purchased at the official online store can only be accepted at the official online store, and returns and exchanges for products purchased at physical stores that carry our products can only be accepted at the store of purchase.
Article 8: Delivery of products
After you place your order, standard items will be delivered within 1 to 3 business days from your order, excluding weekends and holidays. For reserved products, we will follow the announcement regarding the delivery date and time on the product details page, blog, various advertisements, etc.
However, during busy logistics periods such as gift season and sale periods, it may take longer.
The Company will not be held responsible for any disadvantage or damage caused to the customer due to delivery delays due to no fault of the Company, such as disasters, infrastructure problems, or delivery company circumstances.
Article 9: Shipping charges, cash on delivery charges, and product price revisions
We charge customers a flat rate of 550 yen (tax included) as a shipping fee and a flat rate of 330 yen (tax included) as a cash on delivery fee. In addition, our company may revise shipping charges, cash-on-delivery fees, and other product prices without the customer's prior consent due to factors such as market prices or rising material costs.
Article 10: Prohibited matters
You shall not do the following:
- Acts of using the official online store and other services that deviate from normal usage
- Acts that interfere with our business
- Acts that infringe on trademark rights, copyrights, privacy, and other rights, or acts that may be likely to do so
- Application for Internet membership registration based on false registration details
- Orders based on false content, orders based on someone else's Internet membership, or acts of cooperating with them
- Resale of our products, listing and selling on auction sites, preparation thereof, and other requests for orders and samples for commercial purposes
- Credit card fraud
- Unauthorized use of other people's personal information
- Sending or writing harmful computer programs, emails, etc.
- Other acts that our company deems inappropriate
In addition, if the customer falls under any of the above items, our company may restrict, refuse, or suspend transactions, deprive the customer of rights such as membership rank, or cancel or terminate the contract without any demand or notice.
Article 11: Regarding resale, sales on auction sites, etc.
Our company prohibits the resale of products handled by our official online store and physical stores that carry our products, listing or selling them on auction sites, preparation thereof, or any other actions aimed at profit. We will not accept any warranty registrations or repairs for products purchased through other than our official sales channels.
Article 12: Prohibition of transfer of rights
Customers may not transfer their status under these Terms and all or part of their rights or obligations under these Terms to a third party without the prior written consent of the Company.
Article 13: Handling of personal information
We will handle your personal information appropriately based on our personal information protection policy.
Article 14: Severability
Even if any provision or part of this Agreement is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of this Agreement and the remaining portions of the provisions that have been partially determined to be invalid or unenforceable shall remain in full force and effect.
Article 15: Compensation for damages
If the Company is liable for damages in connection with the use of this service, the Company shall be liable for damages up to the total amount of fees paid by the customer to the Company.
Article 16: Governing Law
Japanese law shall apply to the establishment, effectiveness, performance, and interpretation of these Terms.
Article 17: Agreed Jurisdiction
In the event that a problem arises between the customer and the Company due to the official online store, a physical store that handles the Company's products, or other Company services, it will be resolved through mutual consultation.
If the matter cannot be resolved even after consultation, we will file a lawsuit or request mediation, and the summary court or district court that has jurisdiction over the location of our company's head office will have exclusive jurisdiction in the first instance.
